These terms apply when you buy The Bird in Flight System from avianaction.com. Buying the book means accepting them.
Avian Action is operated by Simen Bambic, Australian Business Number (ABN) 89 368 465 326, based in Victoria, Australia.
What you are buying
The Bird in Flight System is a digital book: a single PDF file of around 300 pages, illustrated throughout. It is a download. Nothing is posted to you, and there is no printed edition.
The price is shown in United States dollars. No GST is charged on this sale, and the receipt you are sent is not a tax invoice.
Getting your copy
The download starts from the page you land on after paying, and the same link is emailed to you. Download links expire after a few hours, so that a link cannot be passed around indefinitely. If yours has expired, or the download did not work, write through the contact form with your order number and a fresh link will be arranged.
The file is large. A slow or interrupted connection can stop a download part way through, which is worth knowing before you start it on a phone.
What you may do with the book
The book is for you. You may:
- read it on any device you own
- keep as many copies as you like for your own use
- print it, in whole or in part, for yourself
You may not:
- give, sell, lend or pass on the file, or any part of it, to anybody else
- upload it anywhere others can reach it, including file-sharing sites, cloud folders shared with others, forums or messaging groups
- reproduce its text or photographs in your own work, whether or not you are paid for that work
- use it to teach a paid course or workshop
The text and every photograph in the book remain the property of Simen Bambic. Buying the book buys you the right to read and use it, not to own or redistribute it.
Quoting a short passage in a review, or mentioning what you learned from it, is welcome and needs no permission.
Refunds
Refunds are covered in full on the Refund Policy page. In short: if the book is not for you, ask within fourteen days and your money comes back.
What the book does and does not promise
The book sets out a method that works, explained as clearly as it can be. It cannot promise that any particular photograph will come out, or that your results will match anybody else's. Photographing birds in flight depends on your equipment, your practice, the weather, the birds and a good deal of luck.
What you are buying is the method and the reasoning behind it. What you do with it is yours.
Your rights under Australian law
Nothing in these terms takes away rights you have under the Australian Consumer Law. Those guarantees apply to this sale and cannot be excluded, however anything else on this page is worded.
Among other things, that means the book must match how it has been described. If it does not, you are entitled to a remedy, and the fourteen-day refund offer sits on top of that rather than in place of it.
Changes to the book
The book may be corrected or updated over time. If a new edition is issued, buyers may be offered it, but nothing here guarantees that.
Availability of the website
This website is provided as it is. It may occasionally be unavailable for maintenance or for reasons outside our control. Orders in progress are not affected by a page being briefly unreachable.
Privacy
What happens to your information is set out in the Privacy Policy.
If something goes wrong
Write through the contact form and include your order number. Most problems are a download that did not finish or an email that did not arrive, and both are quick to sort out.
Which law applies
These terms are governed by the law of Victoria, Australia.
Changes to these terms
If these terms change, the new version will be posted here with an updated date at the top. The terms that apply to your purchase are the ones published on the day you bought the book.
